A new bill authored by State Rep. Deb Andraca in the Wisconsin Assembly seeks to prevent individuals who pose significant dangers from possessing firearms, according to the Wisconsin State Assembly.

In essence, this bill allows for the creation of extreme risk protection temporary restraining orders and injunctions, aimed at preventing individuals who pose a significant danger to themselves or others from possessing firearms. A family or household member or a law enforcement officer can petition the court for such orders if they believe a person is likely to cause harm if they own a firearm. If a temporary restraining order is issued, it remains effective until an injunction hearing is held, within 14 days. The restrained person must surrender their firearms either immediately or within 24 hours if personal service isn't possible. Violating the order by possessing a firearm is a Class G felony, and knowingly filing a false petition is a Class H felony. The bill also mandates that the Department of Administration allocate grants for training law enforcement officers in recognizing individuals who are a risk and how to file petitions effectively.

The bill was co-authored by Senator LaTonya Johnson (Democrat-6th District), Representative Clinton M. Anderson (Democrat-45th District), Representative Margaret Arney (Democrat-18th District), Representative Mike Bare (Democrat-80th District), Representative Brienne Brown (Democrat-43rd District). It was co-sponsored by Senator Tim Carpenter (Democrat-3rd District), Senator Kristin Dassler-Alfheim (Democrat-18th District), and Senator Dora E. Drake (Democrat-4th District), along 35 other co-sponsors.
